These Terms govern your creation and use of a TextTags Tag (a "Tag"), whether you create one in the TextTags app or reply to one from your browser. By creating a Tag, or by replying to or otherwise interacting with a Tag, you acknowledge that you have read, understood, and agree to be bound by them. If you do not agree, do not create or use a Tag.
TextTags is for short notifications and quick replies, not extended conversation. Section 1 below says so in the operative language, and it's the single most important thing to understand about what the Service is for. How we handle your information is covered separately in our Privacy Policy.
1. Permitted Use
Tags are provided solely as a mechanism for sending and receiving short notifications and brief, quick replies. Tags are not intended, and may not be used, to conduct extended conversations, ongoing dialogue, or any form of sustained messaging exchange. Any attempt to use a Tag for purposes beyond brief notification and quick-reply communication is outside the intended scope of the Service and may be treated as a violation of these Terms.
2. No Identity Verification; Assumption of Risk
TextTags does not verify, and makes no representation or warranty regarding, the identity, intentions, or trustworthiness of any individual who scans, messages, or otherwise interacts with a Tag. You acknowledge and agree that you are solely responsible for exercising caution and good judgment in any interaction conducted through a Tag, that you should not disclose sensitive personal, financial, or identifying information through a Tag conversation, and that TextTags disclaims any and all liability arising from your interactions with unverified third parties.
3. Device Binding
Each Tag, and each credit or Tag purchased through the Service, is assigned to and tied to the specific physical device on which it was created or redeemed. Purchased Tags function only on the originating device and are not transferable to, or usable from, any other device, account, or installation of the application, except as TextTags may otherwise expressly provide.
4. Duration and Availability
A Tag will remain active and continue to operate — including receiving and relaying messages — indefinitely, until such time as you disable, pause, or delete it, or until TextTags suspends or disables it in accordance with Section 6 below. TextTags does not guarantee uninterrupted availability, delivery, or receipt of any message sent or received through a Tag.
5. Reporting Abuse
If you become aware of abusive, harassing, threatening, unlawful, or otherwise inappropriate conduct or content in connection with a Tag, you agree to promptly report such conduct to TextTags through the reporting mechanisms provided within the application or by contacting TextTags support. TextTags encourages, but cannot guarantee, prompt investigation or resolution of any report.
6. Enforcement and Right to Disable
TextTags reserves the right, in its sole and absolute discretion and without prior notice, to suspend, disable, restrict, or permanently deactivate any Tag — and to restrict the associated device's or account's access to the Service — that TextTags believes, in good faith, has been used in violation of these Terms, in violation of applicable law, or in a manner that TextTags deems abusive, harmful, fraudulent, or otherwise inconsistent with the intended purpose of the Service. TextTags is under no obligation to provide advance warning, explanation, or compensation in connection with any such action.
7. Disclaimer of Warranties
The Service, including all Tags, is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.
8. Limitation of Liability
To the fullest extent permitted by applicable law, TextTags and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or in connection with your creation or use of a Tag, any interaction conducted through a Tag, or these Terms, even if TextTags has been advised of the possibility of such damages.
9. Changes to These Terms
TextTags may modify these Terms from time to time. Continued creation or use of a Tag following any such modification constitutes your acceptance of the modified Terms.
10. Acknowledgment
By creating a Tag, or by sending a reply through one, you affirm that you have read and understood these Terms in their entirety and agree to be bound by them, whether or not you have read them in full.
